Welcome to LunarFlex! The terms “we”, “us”, and “our” refer to LunarFlex. We operate this online store and website, including all associated information, content, features, tools, products, and services, to deliver a curated shopping experience (the “Services”). LunarFlex is powered by Shopify, which supports our delivery of the Services to you.
These Terms of Service (along with all policies referenced within this document) set out your rights and obligations when you use our Services. Please read these terms carefully, as they include important details about your legal rights, including disclaimers and limitations of liability.
By visiting, interacting with, or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not accept these Terms or our Privacy Policy, you may not access or use our Services.

By agreeing to these Terms of Service, you represent that you have reached the age of majority in your state or province of residence. You also consent to allow any minor dependents to use the Services on devices you own or control.
To use our Services — including browsing our store and purchasing products — you may be required to submit information such as your email address, billing details, payment information, and shipping details. You represent and warrant that all information you provide is accurate, up‑to‑date and complete, and that you hold the right to provide such information.
You bear sole responsibility for securing your account credentials and for all activities conducted under your account. You may not transfer, sell, assign, or license your account to any other individual or entity.

We take reasonable measures to display our products accurately. Nevertheless, product colors and visual appearance may differ due to your device model, display settings, and configuration.
We do not warrant that products will meet your expectations or match online images exactly. Product descriptions and specifications are subject to modification at any time without prior notice. We reserve the right to discontinue any product, impose purchase quantity limits, or restrict sales to any person, region, or jurisdiction at our sole discretion.

 

SECTION 3 – ORDERS

When you place an order, you submit an offer to purchase. LunarFlex reserves the right to accept or reject any order for any reason. Your order shall not be deemed accepted until we confirm acceptance and process your payment.
Please carefully review your order before submission. We may be unable to cancel or modify orders once accepted. If we reject, modify, or cancel an order, we will attempt to notify you via the email address, billing address, or phone number you provided.
All purchases are eligible for return or exchange solely in accordance with our Refund Policy. You represent and warrant that all purchases are for personal or household use only, and not for commercial resale or unauthorized export.

SECTION 4 – PRICES AND BILLING

Prices, discounts and promotions are subject to change without prior notice. The price applied to your order shall be the price in effect at the time of order placement, as confirmed within your order confirmation email. Unless otherwise specified, prices exclude taxes, shipping, handling, customs and import fees.
Online prices may differ from pricing at physical stores or third-party retailers. Promotional terms may supersede these Terms to the extent applicable.
You agree to provide up-to-date, complete and accurate payment and account information, and to update details such as your email address, credit card number and expiry date as required. You warrant that you are authorized to use any payment method you submit, and you will pay all applicable charges, including product price, shipping, handling and taxes.

 

SECTION 5 – SHIPPING AND DELIVERY

All delivery timelines are estimates only and are not guaranteed. We shall not be liable for delays caused by shipping carriers, customs processing, or events beyond our reasonable control.
Once products are transferred to the shipping carrier, title and risk of loss pass to you. Shipping is available only within the contiguous 48 United States. Additional white-glove installation service, if selected, is an optional paid add-on and not included in standard shipping.

SECTION 6 – INTELLECTUAL PROPERTY

All content on our Services — including trademarks, text, images, graphics, logos, videos, and page layouts — is owned by LunarFlex, its affiliates, or licensors, and protected under U.S. and international intellectual property laws.
These Terms grant you permission to use the Services solely for personal, non-commercial use. You may not reproduce, distribute, modify, create derivative works, publicly display, republish, or transmit any content without our prior written consent.
LunarFlex’s brand names, logos, product names, and slogans are trademarks of LunarFlex. Shopify’s names and logos are trademarks of Shopify. All other trademarks belong to their respective owners. All rights not expressly granted are reserved.

 

SECTION 7 – OPTIONAL THIRD-PARTY TOOLS

We may grant you access to optional third‑party tools. We exercise no control over these tools and provide them “as is” and “as available”, without warranties or endorsements of any kind.
Your use of third‑party tools is entirely at your own risk. You should review the terms of service of each third‑party provider prior to use. We may roll out new features or tools in the future, and such additions shall also be governed by these Terms.

SECTION 8 – THIRD-PARTY LINKS

Our Services may contain links to third‑party websites. We assume no responsibility for the content, accuracy, or privacy practices of external third‑party sites. Any access or use of third‑party websites occurs at your own risk.
We shall not be liable for any damages arising from third‑party products, services, or websites. Please direct all complaints and inquiries concerning third‑party offerings to the applicable third party.

SECTION 9 – RELATIONSHIP WITH SHOPIFY

LunarFlex is powered by Shopify, which hosts and supports our platform. All sales and transactions are entered into directly with LunarFlex, not Shopify.
Shopify shall not be liable for any sales, products, or related damages arising between you and LunarFlex. You expressly release Shopify and its affiliates from all claims stemming from your transactions with LunarFlex.

SECTION 10 – PRIVACY POLICY

All personal information we collect is governed by our Privacy Policy and, in certain circumstances, Shopify’s Privacy Policy.
By using our Services, you acknowledge that you have read and understood these policies. Information you submit may be shared with Shopify and third‑party service providers located in other jurisdictions, as reasonably necessary to deliver our Services.

SECTION 11 – FEEDBACK

If you submit feedback, reviews, suggestions, or other content (“Feedback”), you grant us a perpetual, worldwide, royalty‑free, sublicensable license to use, reproduce, modify, publish, distribute, and display such Feedback for any purpose, including commercial use.

The following Sections shall survive termination: Intellectual Property, Feedback, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver, Entire Agreement, Assignment, Governing Law, and Privacy Policy.

Information provided via the Services is for general informational purposes only. We make no warranty as to its accuracy, completeness, or fitness for any use.
EXCEPT AS EXPRESSLY STATED BY LUNARFLEX, THE SERVICES AND ALL PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT ANY EXPRESS OR IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT.
We do not warrant that the Services will operate without interruption, securely, or free of errors. Certain jurisdictions prohibit disclaimers of implied warranties, so this disclaimer may not apply to you in full.

SECTION 16 – LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, LUNARFLEX, SHOPIFY, AND THEIR RESPECTIVE AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOSS OF DATA, OR REPLACEMENT COSTS, ARISING FROM YOUR USE OF THE SERVICES OR PRODUCTS, WHETHER BASED UPON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY.

You agree to indemnify, defend, and hold harmless LunarFlex, Shopify, and their respective affiliates from and against all claims, losses, damages, liabilities, and reasonable attorneys’ fees arising out of or related to:

  • Your violation of applicable laws or third‑party rights
  • Your use of the Services
We reserve the right to control the defense and settlement of any indemnified claim at your expense. You agree to fully cooperate and supply all relevant information as reasonably requested.

You may not assign or transfer these Terms, or any of your rights and obligations under these Terms, without our prior written consent. We may assign these Terms at any time, without prior notice.

These Terms of Service shall be governed by the laws of the jurisdiction where LunarFlex is headquartered, without regard to conflict-of-law principles. You consent to the exclusive jurisdiction and venue of the courts located within such jurisdiction.
